SECTION 1 – OVERVIEW & ACCEPTANCE

By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by these terms and conditions. These Terms apply to all users of the site. Please read them carefully. By using our services, you confirm that you have read, understood, and agreed to these Terms, including our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

SECTION 2 – ONLINE STORE TERMS & ELIGIBILITY

By agreeing to these Terms, you represent that you are at least 18 years of age. The Kerminator involves the use of regulated biocidal products (insecticides) which cannot legally be sold to or used by minors.

You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws or regulations in your jurisdiction.

SECTION 3 – PRODUCT USE & SAFETY (THE KERMINATOR SYSTEM)

The Kerminator is a technical pest control tool designed for use with factory-sealed, genuine Kerminator insecticide cartridges only.

Prohibited Refilling:
You must only use genuine Kerminator cartridges. Under the Control of Pesticides Regulations (COPR), it is a criminal offence to decant or repackage insecticides. You agree not to refill, tamper with, or manually load cartridges with third-party or bulk powders.

Liability:
Pest Control Solutions Ltd accepts no liability for injury, environmental damage, or equipment failure resulting from the use of non-approved powders, unauthorised refilling, or misuse of the Kerminator system.

SECTION 4 – MODIFICATIONS TO SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part thereof) without notice.

We shall not be liable to you or any third party for any modification, price change, or discontinuance.

SECTION 5 – ACCURACY OF BILLING & ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order. We may limit quantities purchased per person or household to comply with legal volume restrictions for insecticide products.

In the event of a change or cancellation, we will notify you via the email or billing address provided. Orders may be cancelled if delivery restrictions or regulatory compliance requirements cannot be met.

SECTION 6 – SHIPPING & HAZARDOUS GOODS

All orders containing insecticide cartridges are shipped via ADR-certified couriers (DHL and EVRI). Shipping is subject to our Shipping & Delivery Policy, which is incorporated into these Terms by reference.

You agree to provide a secure delivery location and acknowledge the age-verification requirements and safe handling precautions outlined in our Shipping Policy.

Responsibility for goods passes to you at the point of delivery in accordance with your delivery instructions, including “Safe Place” deliveries.

SECTION 7 – THIRD-PARTY LINKS & TOOLS

We may provide access to third-party tools (such as courier tracking via DHL/EVRI). Access is provided “as is” without warranties. We are not responsible for the content, privacy practices, or accuracy of third-party websites linked from our store.

SECTION 8 – PERSONAL INFORMATION

Your submission of personal information through our store is governed by our Privacy Policy, including the use of cookies, data retention, and third-party processing.

SECTION 9 – PROHIBITED USES

In addition to other prohibitions, you may not use the site or its content:

Misuse or unauthorised modification of products
Use of non-approved cartridges or third-party powders
Any loss, environmental damage, or personal injury related to the Kerminator

This limitation does not affect your statutory rights.

SECTION 11 – INDEMNIFICATION

You agree to indemnify and hold harmless Pest Control Solutions Ltd from any claim or demand made by any third party arising out of:

Your breach of these Terms
Your violation of any law, including UK pesticide regulations
Your misuse of the Kerminator system

SECTION 12 – SEVERABILITY & TERMINATION

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full effect.

SECTION 13 – GOVERNING LAW

These Terms and any agreements whereby we provide Services shall be governed by and construed in accordance with the laws of England and Wales.

Pest Control Solutions Ltd is a startup family business with over 20 years experience in the professional pest control industry. Our primary focus is to develop safer, better targeted and more environmentally conscious pest control solutions for homes and businesses. Launched in 2024, our first product is the Kerminator® Wasp Lance and is designed to bridge the gap between current DIY wasp nest treatments, and the application devices pest control professionals use out in the field.

As a professional pest controller, I treat in excess of 500 wasp nests every season. Many of my customers have wasp nests every year but an increasing proportion call me after they have used DIY powders and foams that have not worked. The familiar sight of excessive spillages of insecticidal dust in roof gutters, over tiles and on patio slabs when I arrive at residential properties has bothered me for many years. And with social media increasingly awash with amateur films featuring home and business owners balancing precariously on ladders to treat their own nests with a variety of homemade application devices, I knew there was a better way.

So I embarked on a 5 year product design journey to bring the Kerminator® Wasp Lance to market - a DIY wasp nest treatment device that anyone can use to safely, accurately and quickly treat their own wasp nest like a professional.

Property management companies, farmers, holiday home owners, trades such as roofers, electricians and window cleaners, as well as private homeowners are all part of a growing network of Kerminator® customers who want to treat their own wasp nests, and save themselves both time and money in the long run.
